Contest “35th anniversary"

Contest rules
(hereinafter the “Rules”)

The competition " 35th anniversary" (hereinafter the “Competition") is organized by Transat Tours Canada Inc. doing business as Transat (hereinafter the "Organizer"). The Contest takes place as of September 7, 2022, at 12:01 a.m., Montreal time (hereinafter the “Competition opening date"), and ends on September 27, 2022 at 11:59 p.m., Montreal time (hereinafter the "Competition Closing Date").

1. Eligibility

The Contest is open to anyone residing in Canada who has reached the age of majority in their province or territory of residence on the Contest Opening Date, with the exception of employees, agents, and representatives of the Organizer, its subsidiaries, its affiliates, its advertising, or promotion agencies, suppliers of materials, prizes and services related to this Contest and any other party directly related to the holding of the Contest, as well as the members of their immediate family, father, mother, brothers, sisters, and children, their legal or de facto spouse and all the persons with whom these employees, representatives, and agents are domiciled.

2. How to participate

2.1 No purchase necessary

2.1.1 Participation in the contest with the completion of the airtransat.com participation form, without purchase, is possible, provided that you complete all the required fields of the form between September 7 and September 27, 2022.

2.1.2 Registrations meeting the criteria of point 2.2.1 will offer the participant (hereinafter the "Participant”) the following odds of winning:

  • For a registration of mandatory fields only = 1 chance to win
  • For adding a reservation number for an Air Transat package, tour, or flight between September 7 and September 27, 2022 = 1 additional chance to win.
  • For subscription to the Air Transat newsletter, with acceptance of the terms and conditions, via the contest entry form OR if the participant is already subscribed to the Air Transat newsletter = 1 additional chance to win

2.2.2.1 Reservation numbers and newsletter registration emails will be validated before the draw to ensure their validity and therefore give them additional chances to win.

2.2.3 The Participant who has completed the form is eligible for the Prize draw (defined below) which will take place on October 21, 2022. Limit of one (1) entry into the Contest per person, which may equal up to 3 chances of win, for the entire duration of the Contest, i.e. between the Opening Date and the Closing Date. Validation will be made based on the participant's email.

2.2 With purchase required

2.2.1 To participate in the Competition, the participant (hereinafter the "Participant") must book an Air Transat product through a participating travel agency, between September 7 and September 27, 2022, whether it is an Air Transat package, tour, or flight, for a trip that will be between September 7, 2022 and May 31, 2023, before the Contest Closing Date to be automatically entered. Group reservations are excluded from this competition.

2.2.2 Registrations meeting the criteria of point 2.1.1 will offer the participant (hereinafter the "Participant”) the following odds of winning:

  • For bookings made with a participating travel agency = 3 chances to win
  • For reservations made through a travel agency such as Club Voyages, Voyages Transat, Transat Travel, and Marlin Travel = the chances are doubled for a total of 6 chances to win

2.1.2.1 To be eligible, reservations must have the minimum payment required may vary depending on the case, except for bookings made 45 days or less from departure date, in which case full payment is required. Promise checks are not accepted proof of payment for the contest.

2.1.3 A Participant who has booked an Air Transat package, tour, or flight is eligible for the Prize draw (defined below) which will take place on October 17, 2022. Limit of one (1) entry into the Contest per person, which can be equivalent to up to 6 chances to win, and this, for the entire duration of the Contest, between the Opening Date and the Closing Date.

2.1.4 In the case of reservation files with several participants and/or several payers: the Participant will be considered as the main payer of the reservation file at the time of the draw, unless Transat Tours Canada Inc receives legitimate instructions at the time of the awarding of the prize. The main payer is the one who has contributed the most funds of all the payers in the file at the time of the draw, or who in the case of a tie, the one who will have paid 1st.

3. Prize

Thirty-five (35) prizes (hereinafter the “Prize”) will be awarded.

3.1 The prices offered (hereinafter the “Prize”) consist of 35 packages for two (2) people in all-inclusive format, including:

Each prize has an approximate retail value of seven thousand six hundred dollars ($7,600 CAD) for a total of two hundred sixty-six thousand dollars ($266,000 CAD) in prizes.

  • Round-trip flight in Economy Class to Mexico, Cuba, or the Dominican Republic
  • Round-trip transfer between the airport and the hotel
  • Accommodation in double occupancy in a Junior Suite category room in one of the Paradisus establishments in the destination selected by Air Transat
  • All meals and drinks as well as the activity program offered by the hotel on an all-inclusive basis
  • Resort fees and hotel taxes

4. Conditions attached to the prizes

4.1 Reservations are subject to the availability of Transat Tours Canada at time the reservation. The terms and conditions of the Air Transat brochures apply. Insurance costs, personal expenses, personal travel insurance, and travel documentation are not included in the Prize. The Organizer strongly recommends that the selected Participant take out travel insurance at the time of booking.

4.2 The Prize must be used between November 1st, 2022 and October 31, 2023, except for the following periods:

  • From December 15, 2022 to January 8, 2023
  • From February 1, 2023 to April 11, 2023

4.3 The Prize offered must be accepted as offered and is not exchangeable, refundable, transferable, or redeemable for cash and no extension of the validity date is permitted;

4.4 The winner (and the passenger of their choice, if applicable) must have the same departure and return dates respectively on the plane tickets;

4.5 The winner and his/her guest are responsible for paying all additional taxes, costs, and fees of any kind relating to their prize (including travel expenses from the residence to the airport, seat selection and airport fees applicable) and any other charges that may be added, including, but not limited to, additional ground transportation (including airport, arrival and departure transportation, other than this which has been agreed), taxes, transport, repatriation and medical insurance, personal expenses, tips, meals, and entertainment activities. Any upgrade (air travel or room) or addition of ancillary products (eg: Option Plus, baggage, seat selection, etc.) are extra and must be paid for by the winner. Any modification to this package will be the sole responsibility of the winner. ;

4.6 Reservations and travel arrangements must be made by the winner. Reservations are subject to availability. They must be made at least one (1) month before the departure date or no later than September 30, 2023 and cannot be modified under any circumstances. The winner must book their trip with Transat ;

5. Drawing

A drawing will be held on October 21, 2022 at 10 a.m., Montreal time, at the Air Transat offices at 300 Léo Pariseau, Suite 1000, Montreal (Quebec) H2X 4C2.

A total of thirty-five (35) random draws will be made among all reservation files made between the Competition opening date and the Competition closing date, as well as among all the web forms completed before the Competition Closing Date.

6. Prize claiming

6.1 In order to be declared a winner, the selected Participant must:

6.1.1 Be reached by email or telephone by the Contest Organizer within five (5) business days following the draw and answer the mathematical skill-testing question that will be asked. If it is impossible to reach the selected Participant by phone or email within seventy-two (72) hours of the draw, for whatever reason, all rights to the prize will be forfeited and the Organizer will proceed with a new drawing. If it is impossible to reach the second (2nd) Participant selected by phone or email within seventy-two (72) hours of the second (2nd) drawing, all rights to the Prize will be forfeited and the Organizer will proceed with a new drawing. If it is impossible to reach the third (3rd) Participant selected by phone or email within seventy-two (72) hours of the third (3rd) drawing, the prize will be forfeited;

6.1.2 Complete and sign the declaration and exemption form (hereinafter the "Declaration form”) which will be sent to them by the Organizer and returned to them within ten (10) working days of receipt thereof.

6.2 The designation of the winners will be made no later than December 1st, 2022.

6.3 Failure to comply with one or other of the conditions mentioned above or any other condition provided for in these Rules, the selected Participant will be disqualified and the Prize awarded to him/her will be forfeited. In the days following receipt of the duly completed Declaration Form, the Organizer responsible for administering the Contest will contact the winner to inform them of how to claim their prize.

7. Personal information

7.1 From time to time, the Organizer may, with the consent of the Participant, use the personal information provided by the latter, for the purpose of:

7.1.1 Communicate with the winner so that the latter takes possession of the prize;

7.1.2 Communicate directly with the Participant regarding the products and services offered by the Organizer, including special offers and information on travel services; and

7.1.3 Conduct a survey regarding the effectiveness of the website, advertising, and sales efforts made by the Organizer.

7.2 The Participant must indicate whether or not they consent to the use of their personal information by checking the box to that effect on the official entry form, or by indicating it on the handwritten entry form sent by the post office. For obtain further information regarding the use of personal information by the Organizer, as described in the Policy on the protection of personal information and respect for privacy adopted by Transat AT inc. and its affiliated companies, the Participant is invited to visit the websites www.airtransat.com and or www.transat.com.

8. Terms and conditions

8.1 The Contest Organizer reserves the right to disqualify a Participant or to cancel their participation if they participate or attempts to participate in this Contest in a manner that does not comply with these Rules. This Participant could be entrusted to the competent judicial authorities. Any decision by the Contest Organizer with respect to this aspect of the Contest is final.

8.2 By participating in this Contest, the selected Participant consent, without receiving additional compensation, to the use of their name, address, city, province, voice, comments, photographs and/or other likeness for advertising or promotional purposes by the Organizer.

8.3 This Contest is subject to federal, provincial, and municipal laws and regulations.

8.4 Incomplete entries, entries received after the Contest Closing Date, lost, incorrect in any way or sent by an unauthorized method are deemed void and will not be accepted in the drawing.

8.5 The Competition is managed by the Organizer. The Organizer will not assume any responsibility for any problem or failure of network, computer online system, peripheral telephone, software, server, provider, email, browser, or for any technical problem which may occur, including but not limited to a transmission or non-transmission problem, regardless of the cause. The Organizer is in no way responsible for the circulation of erroneous or inaccurate information, whether caused by users of the website or by the equipment and/or programs associated with or used by the Contest, or because a technical or human error that may have occurred during the course of the Competition. The Organizer assumes no responsibility for any error, omission, interruption, loss, defect relating to the operation or transmission, breakdown of communication lines, theft, or destruction. The Organizer is not liable for any injury or damage that may result from the holding of the Contest. The Organizer reserves the right to destroy all documents relating to the Competition once the retention period required by law has expired. The Organizer reserves the right, at its sole discretion, to cancel, modify or postpone the Contest at any time, without notice, if any factor prevents the Contest from being conducted under these Rules or in compliance with any law, regulation or policy of any entity having jurisdiction over the Organizer. It should be noted that general conditions apply to this reservation (please consult the current Air Transat brochure);

8.6 In the event of an unforeseen event, Transat reserves the right to modify the dates of the trip by a few days after informing the winner;

8.7 Transat reserves the right to offer a comparable product in the event of program cancellation, force majeure or any other situation beyond Transat's control without any possible recourse from the winner and/or his/her companion;

8.8 Any necessary travel documents (passport, visa, etc.) are the responsibility of the winner (and passengers of his/her choice, if applicable); the latter must obtain them before departure;

8.9 In the event that the winner's guests are minors and the winner is not his/her parent, his/her parent, or legal guardian must sign the declaration form and accept the invitation on his/her behalf so that he/she can take part in the journey ;

8.10 In the event that the winner and their guests do not use part of the prize, no compensation of any kind will be paid to them ;

8.11 The market value of the prize is in Canadian dollars ;

8.12 In the event of loss, theft, mutilation, alteration, or unauthorized use of the prize, it will not be refunded or replaced.

8.13 The contest promoters are not responsible for delays or cancellations concerning the prize, which may occur before or during the trip. Any loss or theft of tickets, certificates, or any other property will not be compensated ;

8.14 By participating in the Contest, the Participant acknowledges having read and understood these Rules and agrees to be bound by them and to comply with them. The Participant certifies that the Rules are understandable and reasonably available for consultation.

8.15 The names of the winners can be obtained by writing to the Contest "35th anniversary”, Air Transat, 300 Léo Pariseau, Suite 500, Montreal (Quebec) H2X 4C2, to the attention of Cathie Bourassa.

8.16 A dispute regarding the organization and conduct of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (hereinafter the "Management") so that it is decided. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping to reach a settlement.
